Alabama Slot Machine Troubles

There has been as of late some confusion as to the difference between what a slot machine is and what it isn’t, as well as what Class II and Class III slot machines are. That definition can have a hard enough time being worked out in the states themselves, but each state has a different idea as to what the slot machine definition should be. As far as the individual states, Alabama is one of those states having a hard time setting a clear cut ruling as to what a slot machine is.

Alabama passed a rule in the 1890’s that said “no purchase necessary.” Because of this ruling, it has led to some problems with the slot machine definitions. Class II machines are currently referred to as Bingo machines, but many think they are just the same as slot machines. Tables aren’t any easier than the slot machines, with some finding a problem with the wording that gambling and table games are illegal – and why the slot machines aren’t as they are gambling as well.

The Jefferson County, Alabama sheriff charged a racetrack with the operation of illegal slot machines. They took it to a judge who said they weren’t slot machines; they were “electronic readers” and were therefore legal, as well as being part of a sweepstakes promotion. Because of the no purchase loophole – they say that the sweepstakes promotion negates the idea that they are slot machines. This leaves both the sheriff and the state in a quandary, as other businesses will also be able to offer slot machines as well as they label them part of a sweepstakes.
