Slot Machine Zoning on Appeal

A group looking to keep slot machines out of Gettysburg filed in the wrong place. They filed their appeal to an earlier ruling on the slot machines in Adams County instead of with the State Supreme Court. The group is trying to stop the slot machines from coming in.

The Straban Township Zoning Hearing Board came to a unanimous decision in October to allow a slot machine casino to come into the commercial zoning district at routes 15 and 30. The group, No Casino Gettysburg, filed an appeal, but filed it in the wrong place. The judge at Adams County said that they needed to file their slot machine appeal at the state level as his court has no jurisdiction over that. There is a stipulation in the casino law that says that all appeals on any slot machines or anything having to do with the law must be filed in the state’s highest court.

"They filed [the slot machine appeal] in the wrong place," said David La Torre, a Crossroads spokesman. "We made a request to have [the slot machine appeal] sent to state Supreme Court. (If we hadn't done that, they) probably would have had a useless hearing at the county level that would have further wasted Straban taxpayer dollars because of No Casino Gettysburg filing in the wrong place."

The group filing the appeal against the slot machine casino said that they thought they had filed it in the proper place, and were fine with it being moved.
