Slot Machines Illegal, Now What?

It is unclear how the state of Alabama will proceed with several of their businesses since the Alabama Supreme Court ruled Friday that they were operating illegal slot machines. A Jefferson County trial judge had deemed the machines not slot machines and therefore found them legal. This ruling overturns the Jefferson ruling and leaves many people asking what will happen now.

Since Judge Scott Vowell ruled them legal in January, there have been many more of these slot machine type parlors popping up all over the city. However, now it is a question of whether this decision will outlaw sweepstakes operations only, or if all adult slot machine parlors in the state will have to close. Milton McGregor is the owner of the Birmingham Race Course, the ones the case was ruled on. He is asking the court to reconsider their decision. "It appears the Supreme Court concluded that our machines only had to resemble a slot machine in order to be a slot machine," he said in the statement. "The truth is our machines are not slot machines."

McGregor opened the MegaSweeps at the end of last year, and then sued the sheriff when Jefferson County police raided the course six days later and seized 1,300 slot machines claiming they were illegal. Vowell said the machines fit nicely into a loophole in Alabama’s gaming laws, and that they were not slot machines.

If a patron wants internet time at a cyber café, they are automatically entered into a sweepstakes at the time of purchase. Prizes are loaded onto the cards that they use to purchase that time, and they are determined by how much the patron used at the slot machines. When you win, you are treated to lights and sounds that are just like a slot machine. McGregor argues that they are not playing for the prizes, they are purchasing time for the café and the winnings are a bonus. He says they are not slot machines, for if they were, the people will only be playing for the prizes.
