Nevada Slot Machines and Smoking

The Nevada Resort Association and the Tavern Owners Association are at odds over smoking and slot machines. The resorts say that they are exempt from the law because they are casinos and they have unrestricted licenses – in other words they can have more than 15 slot machines as well as table games. The taverns say that although they have restricted licenses – they can only have 15 or fewer slot machines and no table games – they are the same entity as the casinos and should be exempt from the law as well.

The law states that the casinos are exempt from the ban, as well as any tavern that does not serve food – no matter how many slot machines they have. The tavern owners say that the casinos also serve food, and that just because they have more slot machines it does not make it right for them to be exempt. Casino attorney Todd Bice said that there were legal distinctions between the licenses, in addition to the number of slot machines that they had. The bars showed pictures of different locations – some restricted and some non-restricted – and they looked the same except for the fact that some had more slot machines than others.

Bice said that the bars were trying to rile up the public by asking if hotel and motel rooms were included in the ban, then the bars said that the casinos should not be exempt because they cater to children. The attorney for the bars, Mike Ferrario said that the distinction between bars and casinos is "ridiculous in the context of protecting children…What differentiates my clients is that we don't reach out to minors."

Ferrario also said that the state should be fostering the slot machine and gambling growth for everyone in the industry, not just the larger casinos. "My clients are just as vital to the economy as Mr. Bice's clients," he said.
