Poker players say that luck and skill are involved in the winning of a poker game. They say that many times it is luck that will get you the cards you need, but it will always be skill that tells you what to do with them. They say that to win consistently you have to have the skills to do so, but there is definitely an element of luck.

However, the idea that skill and luck are interchangeable in the definition of poker could get them into some hot water. Luck and skill could be the deciding factor as to whether or not internet gambling is legal, based on the definition of poker.

According to the laws of the US any game that is mostly luck to win is considered gambling, and any game that uses more skill than luck is not. Because poker is a big draw for online casinos, the government is taking a closer look at their skill to luck ratio.

In 1989 a California court said that it was a game of skill, but six years later, North Carolina said that it was a game of luck – and therefore it was illegal and a gaming room was shut down. The debate keeps getting more and more heated as representatives and senators are now looking to overturn the ban on online wagering – and poker is right in the middle of that mess.

With slot machines, roulette, lotteries, etc, it is only a game of chance. It does not matter who sits at the slot machine or any of the games, the outcome will be the same. However, with poker, depending on who is playing the hand, the outcome of the game can vary greatly. In fact, the IRS even recognizes “professional poker player” as an actual occupation. That in itself should tell the government that it is a game of skill and not chance.
