Slot Machine Lawsuit Moves CourtsThe Pennsylvania State Trooper’s Association is suing the state of Pennsylvania in regards to background checks that the state is outsourcing. The troopers feel that it is in their jurisdiction to be handling all background checks and that it violates the state constitutions separation of powers. They have taken their fight to the state Supreme Court, who refused to hear the case stating that it was not their case to try. They say that the state’s hiring outside private companies to handle the background checks for the slot machine industry is not a violation of any constitutional law. They say that the case must go through the state Commonwealth Court since this is just a case of someone suing a state agency. The troopers say that they are not upset with the ruling, they just want a court to hear their side and why they are upset. They feel that the gaming control board is taking work from them that they are exclusively qualified to handle, and don’t understand why there is a problem with them doing it. With the justices saying that the case is in the wrong court, they feel that it is fine because at least they will be heard in the Commonwealth Court. It was previously decided between the board and the police that the troopers would be doing background checks and running criminal records checks on those employed in the slot machine industry. However, this does not influence the lawsuit.
