Liquor Store Operating Slot MachinesAttorney General Jim Petro has issued an opinion stating that the owners of a “amusement machine” are in fact illegally operating a slot machine. According to Ohio state law, it is illegal to own and operate any slot machine within the state, although with a slot machine measure on the ballot for voting, that slot machine law may change. For now, however, slot machines are illegal, and although the group has been saying that they are not slot machines, they are. According to Petro, any game that operates in such a way as to reward the player a minimum rate of return is a slot machine and not an amusement machine. There is no skill involved, and for it to be ranked as amusement there must be a certain amount of being able to control the outcome. Slot machines do not operate by skill, and no matter how much you play a slot machine, you don’t get any better at it. The Meigs County liquor permit holder that was operating the slot machines has filed an appeal with the Franklin County Common Pleas Court, who will decide for sure if it is a slot machine or not. If they decide that it is not a slot machine the case will be thrown out. However, since Petro has already said that they feel the game is a slot machine, the court will usually follow suit and declare it a slot machine as well.
